How to Register a Trademark in Utah

Introduction

If you have a business idea or product, one of the first things to do is apply for registration. This provides the protection needed to stop others from using your brand name or logo without permission. It’s not difficult to register a trademark in Utah. You can follow the below-mentioned steps as guidance.

Use the TEAS to File your Application.

The USPTO created TEAS as an online application for registering Trademarks. It is the government’s online trademark filing system, so you can’t file a trademark application without using TEAS.

The USPTO provides access to TEAS through a web-based service that allows users to submit applications electronically. You must use this system if you want to register your mark in Utah, as well as other states.

Fill out an Application Form

Filing your applications online through TEAS is simple and straightforward, but you will be required to fill out an application form before accessing TEAS. The top of the form has a dropdown box labeled “Select A Class.” The USPTO recommends choosing one that most closely matches your goods or services, but if this is difficult for you, there are other guidelines as well.

Determine What Class your Good or Service Falls into.

The first step in the process is to determine what class your good or service falls into. The time it will take for your application to be processed depends on the type of class you select. There are six different categories of goods and services:

  • Class 1: Chemicals used in industry, science and agriculture; unprocessed artificial resins, unprocessed plastics; manures; fire extinguishing compositions; tempering and soldering preparations; chemical substances for preserving foodstuffs; tanning substances; adhesives used in industry.
  • Class 2: Paints, varnishes; preservatives against rust and rot;; putty for windows and paints for woodwork, metals, etc.; waterproofing preparations for fabrics, leather etc.; colorants (including dye intermediates); raw natural resins.

File online.

  • Go to the USPTO website and click on the “Trademark Electronic Application System,” or TEAS.
  • Key in your application information and click submit. You will be taken to a payment portal where you can pay online via credit card or PayPal account, with a $100 non-refundable filing fee due at time of submission (a $200 fee is required if your filing includes multiple classes).
  • After submitting payment, you will receive confirmation that your application has been received by email within seven days; for an additional $200 fee per class, you can get an express service option that gets results within three days after submission date—this is ideal when working with multiple classes because it allows more flexibility in case one class takes longer than expected due to backlogs in processing applications from foreign countries such as China where trademark applications may be filed months before they arrive in America
