What Documents should be Prepared to File a Trademark?

Introduction

It’s important to know what documents are required for filing a trademark application, especially if you’re not an experienced trademark filer. Below is a list of documents that we recommend you prepare before filing your USPTO application.

Trademark Application

A trademark application is an official document that will be filed with the USPTO. It includes information about your company and the mark you’re filing, as well as a description of your goods or services. This form can be found on our website along with instructions and checklists to help guide you through the process. The application fee for filing a trademark is $225 per class of goods or services covered by your application.

Documents Necessary to file a Trademark Application

You’ll need to submit a variety of documents to the USPTO with your trademark application. The specific documents you’ll need depend on whether your application is based on use, intent to use, or both.

  • A Statement of Use (SOU) if you’re relying on Section 1(b) or Section 1(d) as the basis for filing your application
  • An Amendment to Allege Use (AAU) if you’re relying on Section 1(c) as the basis for filing your application
  • A Supplemental Declaration if an AAU is needed but has not yet been filed by the deadline specified in 37 C.F.R 2.89(a)(2). If this supplemental declaration is filed later than three months after the end of six months after issuance of an intent-to-use serial number under 37 C.F.R 2.41(b)(1)(iii), it must be accompanied by evidence showing that an AAU was timely filed within three months after issuance of the said serial number. Otherwise, it will constitute grounds for abandonment under 37 C.F.R 2.67(a)(3). It should also include any other required information such as consent under 37 CFR 2 .69 or 2 .71.
